Terms of use

1. Definitions and parties

  • Operator — Global Data Labs LLC, a company registered in Georgia (identification number 402363321), owner and operator of the GetEats service (the "Site" or "Service").
  • Partner — an independent farm or producer selling goods through the Service.
  • Buyer ("you") — a person using the Service to order goods.

GetEats is a marketplace. The Operator acts as an intermediary and not as the seller of the goods; for each order, the seller is the relevant Partner.

2. Subject

The Operator gives you access to a service for finding, ordering and receiving food offered by Partners, on the terms set out here. Using the Service constitutes acceptance of these terms.

3. The Operator's role

The Operator runs the platform and arranges delivery, but is not a party to the contract of sale between you and the Partner. The Partner is responsible for the quality, composition, description and availability of its goods, and the product information is supplied by the Partner.

4. Prices and availability

Prices, assortment and delivery windows are set by each Partner and may change. The final price, the delivery charge and the applicable conditions are shown at checkout. Prices are in EUR. Prices are set by the Partner as seller and include applicable taxes where such taxes apply; the Partner is the taxable person in respect of the goods (see section 3).

5. Placing an order

By placing an order you make an offer to purchase. The contract is concluded between you and the Partner once the order is confirmed. The goods are perishable — please follow the storage conditions stated on the product page.

6. Payment

Payment is made online by card through our payment provider. The Operator does not receive or store card data. Refunds are made to the means of payment used, in accordance with payment scheme rules.

7. Delivery

Delivery is arranged by the Operator through its partner GetTransfer.com. The delivery charge is shown at checkout; during the pilot phase delivery is paid by the Buyer. Delivery times and the service area depend on the Partner.

8. Cancellation, right of withdrawal and perishable goods

  • You may cancel an order until it has been handed over to the courier, by writing to info@geteats.com.
  • Under EU consumer law the 14-day right of withdrawal for distance contracts does not apply to goods liable to deteriorate or expire rapidly (Article 16(d) of Directive 2011/83/EU). This covers most fresh food sold through the Service. For goods outside that category, the right of withdrawal applies on the usual statutory terms.
  • This exclusion concerns only the right of withdrawal: your rights where goods are not as described, defective or not delivered remain fully available (see section 9) and are governed by the mandatory law of your country of residence.

9. Returns and refunds

To claim a refund after a cancellation, or in respect of goods that are not as described, write to info@geteats.com. Refunds are made to the means of payment used, within the period required by law. Quality complaints are handled by the Operator together with the Partner.

10. Personal data

The Operator processes your contact and address data in order to fulfil orders. Your rights as a data subject, the legal bases, the recipients and the retention periods are set out in our privacy policy. You can delete saved addresses and your account in your account settings.

Because the Operator is established in Georgia — a third country outside the EEA for which no adequacy decision has been adopted — personal data transferred from the EU is transferred on the basis of Standard Contractual Clauses, or another safeguard provided for by Article 46 GDPR.

11. Intellectual property

The names, logos, trade marks and content of the Site belong to the Operator or to its Partners, and may not be used without permission.

12. Limitation of liability

The Service is provided "as is". To the extent permitted by law, the Operator is not liable for the quality of Partners' goods, for delivery delays or for payment system failures. This does not limit your mandatory rights as a consumer under EU law.

13. Changes to these terms

The Operator may amend these terms; a new version takes effect when it is published on the Site. Continued use of the Service constitutes acceptance of the changes.

14. Governing law and disputes

These terms are governed by the law of Georgia. However, they do not deprive a Buyer who is a consumer of the protection afforded by the mandatory rules of the country of their habitual residence in the EU, which apply irrespective of the chosen law; a consumer may also bring proceedings before the courts of their place of residence.
